Ordinance 99-3

AN ORDINANCE ADOPTING AND AUTHORIZING THE USE OF A CITATION TO BE ISSUED FOR VIOLATION OF DISTRICT ORDINANCES

The commissioners of Pell Lake Sanitary District No.1, Bloomfield Township, Walworth County, Wisconsin do ordain as follows:

Section 1: This ordinance is enacted pursuant to the provisions of section 66.119 Wis. Stats. for the purpose of authorizing the use of citations for violations of district ordinances.

Section 2: Citations for Ordinance Violations:

(1) a citation issued pursuant to this ordinance shall provide the following information:

A. The name and address of the alleged violator.

B. The factual allegations describing the alleged violation.

C. The time and place of the offense.

D. The section of the ordinance violated.

E. A designation of the offense in such manner as can be readily understood by a person making a reasonable effort to do so.

F. The time at which the alleged violator may appear in court.

G. A statement which informs the alleged violator:

1. That the alleged violator may make a cash deposit of a specified amount to be mailed to the District Treasurer.

2. If the alleged violator make such deposit, he or she need not appear in court unless subsequently summoned.

3. That if the alleged violator makes a cash deposit and does not appear in court, he or she either will be deemed to have tendered a plea of no contest and submitted to a forfeiture, a penalty assessment imposed by section

165.87, a jail assessment imposed by section 302.46(1), a Crime laboratories and drug law enforcement assessment imposed by section 165.755 and any applicable domestic abuse assessment imposed by section 973.055 (1) not to exceed the amount of the deposit or will be summoned into court to answer the complaint if the court does not accept the plea of no contest.

H. A direction that if the alleged violator elects to make a cash deposit, the alleged violator shall sign an appropriate statement which accompanies the citation to indicate that he or she read the statement required under subdivision C and shall send the signed statement with the cash deposit.

(2) Employees of the District authorized to issue citations under this ordinance shall include the District's Treasurer and its Utility Director and any other person delegated such authority by such Treasurer or Utility Director.

(3) A. For each violation of district ordinances an alleged violator shall deposit with the treasurer of the district the sum of two hundred fifty dollars as forfeiture and the appropriate penalty assessment imposed by section 165+87, the jail assessment imposed by section 302.46 (1), and the crime laboratories and drug law enforcement assessment imposed by section 165.755.

B. In lieu of the above the District may adopt by resolution a bond schedule which bond schedule is hereby incorporated by reference.

Section 3: This ordinance shall take effect and be in force from and after its passage and publication according to law.
